INFORMATION FOR CUSTOMERS:

(natural persons, sole traders, partners in commercial partnerships)

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 2016 No. 119, p. 1), hereinafter referred to as the GDPR, I hereby inform you that:

1. The controller of your personal data is Sünkel c.u.e. Sp z o.o. with its registered office at: 66-304 Brójce, Świebodzińska 50, entered in the Register of Entrepreneurs under KRS number 0000126944 kept by the District Court in Zielona Góra, 8th Commercial Division of the National Court Register, NIP 596-13-41-360, tel.: 95 742 98 30, e-mail address: suenkel@suenkel-cue.com.

2. The controller processes your personal data for the following purposes:

a) to complete transactions for the purchase of goods and services,
b) to perform a contract,
c) to comply with legal obligations,
d) to establish, pursue or defend against claims.

3. The controller processes your personal data on the basis of:

a) Article 6(1)(b) and (c) of the GDPR,
b) relevant tax regulations, in particular the Act of 29 August 1997 – Tax Ordinance, the Act of 26 July 1991 on corporate income tax, and the Act of 11 March 2004 on goods and services tax.

4. The recipients of your personal data are:

a) persons authorised in writing by the Controller to process customers' personal data,
b) entities with which the Controller has concluded a data processing agreement and persons authorised in writing by these entities to process personal data (in particular, accounting office, IT service providers),
c) entities authorised under the provisions of law.

5. The Controller does not intend to transfer your personal data to a third country or international organisation.

6. Your personal data will be stored for a period of 5 years from the end of the calendar year following the year in which the last purchase of goods/services took place or the last settlement in this respect was made, whichever occurred later.

Personal data may be stored for longer than the periods indicated above if such an obligation arises from legal provisions or is necessary in connection with the establishment, investigation or defence of claims arising from the purchase of goods/services.

7. You have the following rights:

a) the right to access your data and receive a copy thereof (Article 15 of the GDPR), whereby only the first copy of the processed data is provided free of charge, and the Controller may charge a fee for subsequent copies;
b) the right to rectify your data, including supplementing it (Art. 16 of the GDPR);
c) the right to erasure, the so-called ‘right to be forgotten’ (Art. 17 of the GDPR), if the Controller has no legal basis for processing the data;
d) the right to restrict processing (Art. 18 of the GDPR), to the extent that the Controller processes data without a legal basis;
e) the right to data portability (Article 20 of the GDPR), in relation to data provided by you to the Controller, which is processed by automated means;
f) the right to lodge a complaint with a supervisory authority (Article 77 of the GDPR).

8. Providing personal data is voluntary, but refusal to provide it makes it impossible to conclude and perform the contract.

9. Your data will not be used as a basis for automated decision-making and will not be profiled.

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 2016 No. 119, p. 1), hereinafter referred to as the GDPR, we hereby inform you that:

INFORMATION FOR EMPLOYMENT CANDIDATES:

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 2016 No. 119, p. 1), hereinafter referred to as the GDPR, we hereby inform you that:

3. The Administrator processes your personal data on the basis of:

a) consent, i.e. Article 6(1)(a) of the GDPR,
b) Article 6(1)(b) of the GDPR and Article 221(1) of the Labour Code Act of 26 June 1974.

4. The recipients of your personal data are:

a) persons authorised in writing by the Controller to process the personal data of Job Applicants,
b) entities with which the Controller has concluded a data processing agreement and persons authorised in writing by these entities to process personal data (in particular, IT service providers).

5. The Controller does not intend to transfer your personal data to a third country or international organisation.

6. Your documentation will be stored until the recruitment process for the position you have applied for is completed.

7. You have the following rights:

a) the right to withdraw your consent to the processing of your personal data (Art. 7(3) of the GDPR), whereby the withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal,
b) the right to access your data and receive a copy thereof (Art. 15 of the GDPR);
c) the right to rectify your data, including supplementing it (Article 16 of the GDPR);
d) the right to erasure, the so-called ‘right to be forgotten’ (Article 17 of the GDPR); e) the right to restriction of processing (Article 18 of the GDPR); f) the right to lodge a complaint with a supervisory authority (Article 77 of the GDPR).

8. Providing personal data is voluntary, however, refusal to provide such data will prevent you from participating in the recruitment process.

9. Your data will not be used for automated decision-making and will not be profiled.

The recruitment advertisement should include the following clause:

The applicant is required to read the Information for Employee Candidates, which is attached to the recruitment advertisement or posted on the Employer's website www.suenkel-cue.com.

In accordance with Article 221 § 1 of the Labour Code, the application documents should only contain the following information: first name(s) and surname, parents' names, date of birth, place of residence (correspondence address), education and employment history, as well as contact details, e.g. telephone number, e-mail address.

In order to participate in the recruitment process, the following clause must be included in the application documents:

"1. I consent to the processing of my personal data contained in the application documents – in accordance with Article 6(1)(a) of the GDPR.
2. I confirm that I have read the information for Job Applicants."
